Land transfer
A comprehensive review of the Aboriginal Lands Trust in 1996 (Bonner Report) recommended that all Aboriginal Lands Trust land be transferred back to Indigenous ownership. Following that, the Aboriginal Lands Trust embarked on a divestment program. Consequently DIA increased its level of support to the Aboriginal Lands Trust o assist in its implementation.
The issues involved in the transfer of Aboriginal Lands Trust land can be complex. There are a variety of factors that impact upon the transfer process, including native title, reconciling competing interests over the land and the capacity of Indigenous organisations to meet the responsibilities associated with owning and managing land.
Transfer processes may require lengthy consultation, negotiation and mediation with occupants of the land, traditional owners, and persons holding historical interests (as distinct from traditional interests), Native Title Representative Bodies, Local Government and other Government agencies.
To facilitate a more effective process, the Aboriginal Lands Trust has developed strategic partnerships with Indigenous organisations, including utilising formal agreements. The main aims of these agreements are to:
- Facilitate the transfer of the ALT estate through identified priorities;
- Increase positive land outcomes for Aboriginal people across the State; and
- Provide appropriate post-transfer support to new landholders for the management of their land.
